INTRODUCTORY PROVISIONS
Szo-Ko Invest Ltd. (registered office: 1121 Budapest, Kakukk út 29., company registration number: 01-09-178598), hereinafter referred to as the “Company”, provides tourist and recreational cruise services on the Danube River under the brand name "Budapest by Elizium – The Danube Yacht Experience", including ticket sales via online platform.
The Company’s services, as well as the terms of use and travel, are described in detail at https://www.eliziumyachtbudapest.hu. These General Terms and Conditions (GTC), the booking platform policies, and the information published on the Company’s website form the basis of the legal relationship between the Company and the Passenger.
By purchasing a ticket or using the services, the Passenger acknowledges that they have read and accepted the content of this GTC as binding.

Gift certificate: A non-personalised, digital voucher valid for 12 months from date of issue, transferable, and redeemable for services defined by the Company.

I. SCOPE
1. Personal Scope
These General Terms and Conditions apply to the Company and to all natural persons using its services (Passengers).
2. Material Scope
The present GTC covers all tourism and event-based services provided by the Company, including sightseeing cruises, themed programs, dinner cruises, and private boat rentals.
3. Territorial Scope
This document is applicable to all Company-operated vessels, the departure port (Wiking Marina Port – Budapest, Kelén Street), and navigation on the Budapest section of the Danube.
4. Temporal Scope
This GTC enters into force on the date of publication and remains valid until revoked. The Company reserves the right to unilaterally amend the GTC, which takes effect upon publication on the website.
II. RELATION TO OTHER TERMS
The contractual relationship between the Company and the Passenger is governed by:
• this General Terms and Conditions (GTC),
• the Passenger’s completed online reservation and the confirmation received from the booking platform,
• the publicly available information published on the Company’s website.
Unless otherwise specified, the provisions of the Hungarian Civil Code (Act V of 2013), the Act XLII of 2000 on Water Transport, and the Government Decree 45/2014 (II.26.) on contracts between consumers and businesses shall apply.
III. SERVICES PROVIDED BY THE COMPANY
The Company provides tourism and event-based boat services on the Danube River in Budapest, including:
• Sightseeing yacht cruises
• Sunset cruises
• Live music dinner cruises
• Themed gastronomic cruises (e.g., wine tasting, cocktail evenings)
• Private yacht rentals for corporate or personal events
• Optional add-on services (e.g., unlimited drinks, decoration, live music)

IV. CONCLUSION OF CONTRACT, TICKET PURCHASE
The contract between the Company and the Passenger is concluded upon payment and confirmation of the ticket via the online platform available at www.eliziumyachtbudapest.hu.
The booking becomes legally binding once the ticket fee is paid and a confirmation email is issued by the booking system.
The language of the contract is Hungarian, and it does not qualify as a written contract under civil law.
Accepted payment methods:
• Bank card (online)
• Advance bank transfer
By purchasing a ticket, the Passenger accepts the current GTC as binding and acknowledges that they have read and understood its content.
V. TICKETS
Only valid reservations entitle the Passenger to participate in the cruise. After a successful booking, a confirmation email is sent via the online platform, serving as proof of eligibility to board. No physical ticket is issued.
Services are available exclusively with a valid booking, and participation is subject to capacity limitations (maximum 12 persons per cruise).
Passengers are responsible for arranging their own travel insurance, as the Company does not provide accident, baggage, or liability insurance. The Company is not involved in obtaining such coverage.
8. VI. GIFT CERTIFICATES
The Company offers the option to purchase digital gift certificates through its website: www.eliziumyachtbudapest.hu.
Gift certificates are:
• non-personalized,
• valid for private boat rental for up to 10 persons,
• valid for 12 months from the date of issue,
• fully transferable,
• redeemable upon prior booking, subject to availability.
Certificates cannot be exchanged for cash, cannot be used partially, and are redeemable in a single transaction. The Company is not liable for lost, destroyed, or damaged vouchers.
In case of program cancellation due to weather, the Passenger may choose to:
• reschedule the program, or
• receive a voucher valid for 12 months, transferable to any other date or person.
The Company does not verify the identity of the voucher holder and excludes liability for loss, destruction, or unauthorized use of the voucher.
VII. PRIVATE BOAT RENTAL
The Company offers exclusive boat rental for private events (e.g., birthdays, corporate events, weddings). Rental is subject to a custom offer and individual agreement.
Requests may be submitted via email or the website. The Company provides a professional crew during all rentals to ensure safe operation.
Rental terms such as date, duration, fees, catering, and optional services are always subject to individual negotiation and shall be detailed in a separate agreement.
VIII. HAND LUGGAGE
Passengers may bring one piece of hand luggage per person, not exceeding 60 cm in size and 10 kg in weight. Luggage must not obstruct boarding, disembarkation, or onboard movement.
Permitted items include:
• small bags, backpacks,
• baby strollers, umbrellas.
Not permitted:
• bicycles, scooters,
• large suitcases or travel baggage.
Luggage must be stored according to the instructions of the crew. The Company is not liable for lost, stolen, or damaged personal belongings.
IX. ANIMAL TRANSPORT
Animals are not generally permitted aboard, with the following exceptions:
• guide dogs for visually impaired persons,
• assistance dogs for people with reduced mobility,
• official service dogs (e.g., police dogs on duty).
In all permitted cases, the animal must be leashed and muzzled at all times. The owner is fully liable for any damage caused by the animal.
X. ONBOARD CATERING
Catering services are available on board and vary depending on the program type.
• Beverages: may be included or available for purchase.
• Meals: a seated dinner is provided for certain programs.
Menu options and drink packages are described on the booking platform. Bringing your own food or beverages is strictly prohibited, unless specifically permitted by individual agreement.
If the Customer intends to serve externally sourced food or beverages, it must be approved by the Company in writing. Such approval does not extend to any warranty or liability for the quality or safety of those items.
XI. CONDITIONS OF PARTICIPATION AND EXCLUSION
Only Passengers with valid bookings are allowed to board and participate.
Restrictions and Grounds for Exclusion:
The following individuals may be denied boarding or excluded from the cruise:
• anyone arriving in a state of severe intoxication impairing judgment,
• individuals behaving disruptively or offensively,
• persons suffering from infectious diseases,
• anyone who endangers the safety of navigation, other passengers, the crew, or the vessel,
• persons failing to comply with onboard conduct rules,
• those with invalid tickets or unable to present proof of purchase,
• individuals whose clothing or belongings may soil or contaminate the vessel or others’ belongings.
After the cruise has begun, the captain is entitled to disembark the Passenger at the next available port if any of the above apply.
Passengers incapable of self-care and children under 14 may only travel with an accompanying adult. Boarding without a companion is deemed declaration that the person is 14 or older.
In case of illness or injury during the trip, the Company shall transport the Passenger to the nearest port to receive medical assistance.
Passengers under 18 may not be served alcohol. The crew may verify age using official documents.
If infectious disease is suspected, the Passenger may be isolated from others if possible.
Passengers excluded due to their own behavior are not entitled to a refund.
The Company may refuse boarding if the number of Passengers has reached the maximum authorized capacity or the safe limit determined by the Company.
XII. LIMITATION OF LIABILITY
The Company reserves the right to:
• modify the program duration, route, or vessel,
• cancel any cruise due to weather conditions or technical reasons.
In such cases, the Company will:
• reschedule the Passenger’s booking to the next available date, or
• issue a gift certificate valid for 12 months, at the Passenger’s choice.
In the event of cancellation due to adverse weather, no additional compensation shall be payable.
The Company’s liability for any damages is limited to 100% of the paid ticket price.
Audio and video recordings may be made on the ships and in the port area for security or marketing purposes. The Company’s Privacy Policy is available as a separate document on the website.
XIII. RIGHTS AND OBLIGATIONS OF PASSENGERS
Passengers with valid bookings are entitled to use the Company’s services and onboard facilities.
Passengers are obliged to:
• arrive at least 15 minutes before departure time,
• present their ticket or confirmation,
• follow all instructions of the crew and captain,
• behave in a cooperative and respectful manner,
• refrain from any behavior that disturbs the service or other passengers.
In the port and onboard, Passengers may only enter designated areas. Persons excluded from travel, or those carrying prohibited items, may not enter.
Strictly prohibited:
• disturbing or harassing crew or passengers,
• smoking in undesignated areas, especially inside enclosed cabins or restrooms,
• polluting, damaging, or contaminating the vessel or port,
• leaning out of windows, jumping into the water or threatening to do so,
• pushing or encouraging others to jump into the water,
• endangering oneself or others in any way.
Such actions may lead to police intervention, fines, and a contractual penalty of EUR 5,000 payable to the Company. This shall be converted into HUF based on the MNB daily exchange rate.
In the event of a nautical incident or accident, the Passenger must follow all safety instructions.
The Company is not obligated to provide the service if the Passenger arrives late, fails to present a valid ticket, or obstructs departure.
Passengers must comply with all applicable Hungarian laws and navigation regulations. Any costs or damages arising from non-compliance shall be borne by the Passenger.
Minors:
• Children under 14 years may only travel with an adult escort.
• Persons under 18 years may not be served alcohol. The crew is entitled to request proof of age.
Passengers suspected of having an infectious disease may be isolated, and sick or injured passengers may be disembarked at the nearest port to receive medical assistance.
XIV. RIGHTS AND OBLIGATIONS OF THE COMPANY
The Company undertakes to:
• provide the service at the announced time and location,
• operate the vessel in a safe and seaworthy condition,
• enforce safety rules during navigation,
• respond to passenger complaints within the legal deadline,
• publish all relevant passenger information on its website.
The Company reserves the right to:
• change vessels, programs, or departure times,
• deny service for safety or operational reasons,
• suspend or cancel the cruise in case of force majeure, technical malfunction, or threat to health/safety.
Force Majeure
Force majeure includes, but is not limited to:
• a boating accident or collision with another vessel,
• mechanical failure or operational malfunction of another vessel or watercraft,
• governmental orders, border closures, or bans on mooring or navigation,
• removal of explosive devices (e.g., bombs, mines),
• extreme weather conditions (e.g., storm, flooding, high winds, or extreme temperatures),
• strikes or labor stoppages,
• low water levels,
• presence of hazardous driftwood or floating obstacles,
• quarantine or cordon sanitaire,
• epidemic situations or public health restrictions,
• disturbances caused by another passenger or third party,
• criminal acts or acts of terrorism,
• illness of the ship’s crew,
• sudden illness or life-threatening condition of a passenger,
• military exercises, operations, acts of war or warfare,
• mine-related hazards,
• construction works involving bridges or waterways,
• malfunction of tunnels, locks, or lifting mechanisms,
• water ingress into the ship’s hull,
• fire onboard,
• any other technical malfunction,
• any other unavoidable and unforeseeable event beyond the Company’s control.
In such cases, the Company will notify the Passenger without delay and offer either a new date or a gift certificate. No further liability or damages may be claimed.
XV. CANCELLATION AND WITHDRAWAL
The Passenger may withdraw from the booking under the following conditions, based on the time remaining until the scheduled cruise:
• More than 7 days before departure: full refund of the ticket price.
• Between 48 hours and 7 days: 50% refund.
• Less than 48 hours before departure or no-show: no refund.
In the event of cancellation due to force majeure or weather, the Company will notify the Passenger, who may choose to:
• reschedule the cruise to a new date, or
• receive a gift certificate valid for 12 months, transferable and redeemable at any future available date.
XVI. TICKET REFUNDS
Refund requests must be submitted via the same platform where the original booking was made.
Refunds will be processed:
• using the same payment method used for the original booking (e.g., bank card, transfer),
• in the original currency,
• within 10 business days of approval.
The Company may request proof of purchase and booking ID before processing the refund.
XVII. COMPLAINT HANDLING
Passengers may submit complaints in writing no later than 10:00 AM on the day following the cruise, using the following channels:

This deadline is statutory and final. Passengers are liable for any consequences of late submission.
The Company shall respond to written complaints within 30 days.
Any passenger claim arising from the transport service – unless a shorter deadline is specified in this GTC – shall expire within 3 months.
XVIII. LEGAL DISPUTE RESOLUTION
The Company and the Passenger agree to resolve any disputes amicably whenever possible.
If no agreement is reached, the dispute shall fall under the jurisdiction of the ordinary court with competence based on the Company’s registered seat.
The Company is not subject to any code of conduct.
In the event of an individual agreement (contract) with the Customer, any differing provisions shall prevail over these General Terms, and such contract shall be considered an annex hereto.
XIX. MISCELLANEOUS
This GTC is published in Hungarian on the Company’s website. An English version is available upon request, but in the event of any discrepancy, the Hungarian version shall prevail in legal matters.
The Company may record audio and video at the port and onboard for security, documentation, or marketing purposes. A detailed Privacy Policy is under development and will be made available on the website.

2. Principles and Legal Framework
The Data Controller processes personal data in accordance with the General Data Protection Regulation (GDPR), the Hungarian Act CXII of 2011 on informational self-determination and freedom of information (Infotv.), and other relevant national and EU laws.
All processing is carried out lawfully, fairly, and transparently, and adheres to the following principles:
• purpose limitation,
• data minimisation,
• accuracy,
• storage limitation,
• integrity and confidentiality.

4. Data Retention Period
• Ticket bookings: 5 years from contract completion (in line with accounting obligations)
• Contact inquiries: 6 months from resolution

• Gift vouchers: 1 year after expiry
5. Data Transfers and Data Processors

6. Data Subjects' Rights
Data subjects have the right to:
• access their personal data,
• request rectification,
• request erasure (“right to be forgotten”),
• request restriction of processing,
• object to processing based on legitimate interest,
• request data portability,
• withdraw consent at any time.

7. Remedies
If the data subject believes that their personal data is being processed unlawfully, they may lodge a complaint with:

Cancellations made 48 hours - 7 days before the program will receive a 50% refund or credit towards future bookings.
If you cancel within 48 hours, no refund will be provided.
No show – no refund will be applied
Our boats operate under all weather conditions, including snow, rain, and storms. There are a few exceptions, though, and in such cases, we will make announcements on all available platforms to inform youif your cruise is cancelled, including SMS, email, public announcements on Instagram, and our website. Please note that bad weather does not allow you to change your ticket for free. Our policy is simple: no-show, no-refund. The boat features a covered deck, providing comfort regardless of the weather, and it’s especially pleasant during storms or colder conditions. Rain or bad weather does not qualify as a special circumstance for a ticket change.

The start times of the programs vary based on availability. Standard departure times are between 10:00 AM and 10:00 PM.You can request a specific time, subject to availability.

Yes, we offer gift certificates for all our yacht programs! Gift certificates are available for any amount and can be redeemed towards any of our experiences. Please contact us directly for more details or to purchase a gift certificate.
Recorded music will be played during the program.You can provide your own playlist, or we can assist with creating a music selection that suits your preferences. Some programs offer live music as an add-on, which you can book after you made your reservation.
Yes, there is a restroom on board for your convenience.
Yes, there is a stateroom available for changing clothes and storing your belongings. It is safe, and we ensure that all personal items are stored securely.
Yes, the yacht is equipped with both heating and air conditioning to ensure comfort in all seasons.
Yes, there is a bar on board. We offer a selection of premium drinks including sparkling wine, wine, beer, premium liquors, soft drinks, and water. Additional drink packages are available upon request.
Guests are not permitted to bring their own food or drinks. We offer a variety of drinks and catering options on board to enhance your experience.
Smoking is prohibited inside the yacht. Designated smoking areas are available on the outdoor decks.
No pets are allowed on board. If requested, we can provide a pet sitter at the Marina during your trip.

Yes, you are welcome to bring your own cake for the birthday cruise. However, please inform us ahead of time so we can make the necessary arrangements.
We recommend comfortable, weather-appropriate attire. For evening programs, smart-casual dress is encouraged. Don't forget your camera to capture the stunning views! Please remember that no shoes policy applies on board!
Please note that the price is for the entire boat. In case of fewer guests, the full price for the boat is still charged.
All programs depart from the Wiking Marina Part Marina located at 13th District, Kelén utca. Exact boarding details will be provided after booking confirmation.
The closest underground station to the Marina Part Dock is Forgách utca (Line M3 to Ujpest, 6 stops from Deak Ferenc tér Station ).
It’s just a short walk to the dock from there, making it easy to reach us by public transport.
The Wiking Marina Part has a public parking. Please note that it is a paid parking zone!
The yacht is not available for people in wheelchairs. Guests should be able to step stairs upwards and downwards to access the yacht. Please participate at your own risk and notify us of any special needs in advance.
The city lights and illuminated sights turn on at sunset and stay illuminated throughout the evening until midnight. Our programs are perfect for enjoying the beautiful cityscape as it lights up at night. Please note that we do not control the city’s public lighting, so we do not bear responsibility for it.
